What is this Litigation about?

A proposed Settlement of a class action lawsuit is pending in the Charleston County Court of Common Pleas, South Carolina. The lawsuit deals with patients of East Cooper Regional Medical Center, Hilton Head Regional Medical Center and/or Piedmont Healthcare System (collectively referred to as the "Hospitals"), who were not provided with a statutory discount to which they were allegedly entitled. The Hospitals deny that they acted improperly or wrongfully in any way and deny any and all allegations of wrongdoing, fault, liability, or damage of any kind to Plaintiffs or other patients. Plaintiffs contend that these charges were excessive, unfair and unconscionable. The Hospitals deny any wrongdoing but are settling the case to avoid the time and cost of litigation.

Who are the Class Members?

You are a Class Member if you were a patient at East Cooper Regional Medical Center, Hilton Head Regional Medical Center and/or Piedmont Healthcare System during the period October 7, 2001 through May 22, 2006. You may be eligible to receive benefits under this Settlement if you had no health insurance at the time of treatment and if you paid money out-of-pocket within 30 days of receiving the original bill from one of the Hospitals for service rendered to you.



How do I obtain the benefits of the Settlement?

The Hospitals have agreed to pay all administrative costs and Class Counsel’s attorney fees. Participating in the settlement will be of no cost to Class Members.

The Court granted Final Approval of the Settlement on August 29, 2006. In order to obtain the benefits of the Settlement, you must complete a valid Claim Form by September 15, 2006, and mail it to the Settlement Administrator at the following address:

When is the Settlement Hearing and can I attend?

The Court granted Final Approval of the Settlement at the Fairness Hearing held on August 29, 2006.
